PUTRAJAYA, 5 April 2022 - To ensure that electronic cigarette devices produced and imported comply with the safety standards of the Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) would like to inform that the Trade Description (Certification and Marking) of Electronic Cigarette Devices (VAPE DEVICE) Order 2022 under the Act Trade Description 2011 was gazetted on 5 April 2022 (Tuesday). The order will take effect on August 3, 2022 (Wednesday).

This order requires manufacturers and importers of electronic cigarette devices to apply for MS SIRIM certification and marking from SIRIM QAS International Sdn. Bhd. as the Competent Authority appointed by KPDNHEP. The MS SIRIM marking shall be placed on the electronic cigarette device, its spare part or on the container of the supplied device which is easily visible to the user. The presence of MS SIRIM marking on the electronic cigarette device indicates that it has complied with the standard and is safe to use.

The following are the enforcement actions that can be taken by the Ministry in the event of non -compliance by manufacturers and importers as follows:

Company: fined not exceeding RM 200,000.00. For a second or subsequent offense, a fine not exceeding RM500,000.00.
Individuals: fined not exceeding RM 100,000.00 or imprisoned not exceeding 3 years or both. For a second or subsequent offense, a fine not exceeding RM250,000.00 or imprisonment for a term not exceeding 5 years or both.
This gazetting is an initiative of the Government concerned with the spirit of the Malaysian Family to safeguard the well -being of the people and protect the interests of consumers.

Finally, KPDNHEP hopes that the issue of dumping of low quality electronic cigarette devices in the Malaysian market will be resolved with compliance with standards by manufacturers and importers.
